It is looking increasingly promising now. Before they would offer terms for a policy the insurers wanted to know when we heard back from Vivid’s solicitors, which we did yesterday. They have confirmed Vivid will enter into a deed of variation. I have informed the insurers and I am waiting to hear from them with confirmation they are willing to issue a policy. I should get that confirmation today.
Vivid’s solicitors do require an undertaking to pay their costs which are £350 plus VAT (reasonable in my experience). It would be normal practice for the seller to pay these. I emailed Pam yesterday afternoon and asked if she would be able to give that undertaking to Vivid’s solicitors. I think Pam had limited availability yesterday but no doubt I will hear from her this morning.

I have spent much time yesterday and this morning trying to find a way to resolve the issue because both my client and the seller are very keen to see this go ahead with the minimum possible delay.
We have been waiting to hear from the solicitors acting for Vivid Housing with confirmation that their clients will be willing to enter into a deed of variation to correct the defective lease plan. I emailed the solicitors, Pennington’s, earlier this morning and they have kindly replied to me and said they are chasing the matter.
In the meantime, I am looking into the question of getting an indemnity policy which would address the problem in the short term so that we could deal with the deed of variation after completion. I sent a presentation over to the indemnity insurers earlier this morning explaining the position in detail and asking them to confirm that they will be able to offer the requested cover.
I do know that from our client’s point of view this matter is extremely urgent and we are giving it priority. I hope to find a way through imminently.

Alisha and I have discussed your purchase this morning. I am fully up to speed anyway as I looked at the title originally and I understand what the problem is.
I tried to speak to the sellers’ solicitor on the telephone but couldn’t get through to the right person. I have sent her an email explaining the urgency and asking if they can give us the contact details so we can speak to Vivid housing ourselves. It all turns on that really.

I chased up the Seller’s Lawyer this morning again and they provided me with the below response:
I have sent all the documents over to the landlord and I am waiting for them to let me have costs and draft deed of variation.
I will chase them.
In the meantime, I am going to contact an indemnity provider to ask whether they can provide me with a cost for an indemnity policy for the missing lease colouring (this would usually be covered by the seller). This would be a short-term fix which will enable us to proceed and cover the position in between completion and the point where we get the Deed of Variation from Vivid. Of course, if it becomes clear that Vivid are willing to deal with it quickly then we may not need the policy at all.
I will let you know how I get on.

I hope you’re well. I just wanted to check in as we are now coming into the fourth month of the purchase process for this no-chain property.
As you know, my circumstances are a little delicate, and the ongoing uncertainty is becoming increasingly difficult for us as a family. I’m very conscious that I may soon need to consider alternative options, such as renting, simply to provide some stability for my children, as I can’t remain where we are indefinitely.
The prolonged stress has also had an impact at home. My daughter’s mental health has been particularly affected, and she has started self harming again, which makes it even more important for me to ensure we have a secure and settled living situation as soon as possible.
I would be very grateful for an update on where things currently stand, anything that remains outstanding, and whether there is a realistic timescale for moving this forward. Having that clarity would really help me to make the right decisions over the coming weeks.

Unfortunately, if not rectified the same issue will come up if Bianka decides to sell in the future and usually the seller would have to cover the cost of such an issue.
